TERMS AND CONDITIONS

Terms and Conditions (also referred to as “Terms”).

  1. The Promoter

The Promoter is Aposiopesis Limited, trading as Cotswold Competitions, registered under company number 13011814, with a registered office at Castle Lodge, Spring Lane, Cheltenham, GL52 3PY (the “Promoter”).

  1. The Competition
    1. These Terms apply to all competitions (each a “Competition”) listed on the Promoter’s website: http://www.cotswoldcompetitions.co.uk/ (the “Website“).
    2. There are two methods of entry into our Competitions:
      1. An entry fee is payable each time you enter via our online entry method (“Online Entry Route“); or
      2. you may enter for free via the postal entry method outlined in paragraph 3.9 below (“Postal Entry Route“).

A person who enters either via the Online Entry Route or the Postal Entry Route is an “Entrant”, for the purpose of these Terms.

    1. Below is a step by step summary of the Competition mechanics:
      1. an individual will create an account on the Website;
      2. the individual can then select the Competition that they wish to enter, from the list on the Website;
      3. the individual can select to enter the Competition via the Online Entry Route or Postal Entry Route Steps (detailed steps set out below). Both routes will require the Entrant to answer a skill-based question;
      4. once the Competition is closed, if the minimum ticket threshold has been reached, a random number generator will be used to select a winner, from the Entrants who successfully answered the skill-based question; and
      5. the prize will be allocated to the winner, as per the terms below.
  1. How to enter
    1. Each Competition will run from the “Published Date” to the “Closing Date” inclusive, as listed on the Website. 
    2. All Competition entries must be submitted to the Promoter no earlier than the Published Date and must be received by the Promoter by no later than 18.00 hours (according to the time in London, England) on the Closing Date. All Competition entries received prior to the Published Date or after the Closing Date will automatically be disqualified.
    3. The times and dates listed on the Website refer to the time and date as is it is in London, England.
    4. For each Competition, the Website will list the number of entries that must be received via the Online Entry Route by the Closing Date (“Minimum Ticket Threshold”), in order for the Competition to proceed and a winner to be selected. 
    5. The Promoter reserves the right to withdraw the Competition, where the Minimum Ticket Threshold is not reached for a Competition. The Promoter will refund, in-full, the entry fees paid to enter the Competition via the Online Entry Route. The Promoter shall not be required to individually notify those Entrants who have entered the Competition via the Postal Entry Route, save for a notice being placed on the Website.
    6. The Promoter reserves the right to change the Closing Date, where it is forced to do so by circumstances beyond the Promoter’s reasonable control. Where the Closing Date is changed, the Promoter will take all reasonable steps to ensure Entrants who complied with the original Closing Date are not disadvantaged in any way and the new details will be communicated to Entrants by email and via the Website.
    7. To enter a Competition, you will first need to create an account on our Website. This is a requirement whether you enter via the Online Entry Route or Postal Entry Route. Any entries received via the Postal Entry Route that do not correspond to a registered account will not be entered into the Competition. Once you have an account, to enter:

Online Entry Route

      1. via the Online Entry Route, follow the following steps:
        1. Go to the Website and find the Competition you wish to enter;
        2. Input an answer to the Competition question;
        3. Select your desired number of entries;
        4. Proceed to checkout;
        5. You will have an option to log in to your account or fill in the boxes provided to create an account;
        6. Tick the box provided to agree to our Terms;
        7. Select your method of payment and proceed to complete your entry or entries.

You will receive an email confirmation once the entries have been successfully entered.

Postal Entry Route

      1. via the Postal Entry Route:
        1. Send your entry by first or second class post to the Promoter at the following address: Cotswold Competitions, Castle Lodge, Spring Lane, Cheltenham, Gloucestershire, England, GL52 3PY.
        2. You must Include the following information on the entry:
          1. Your full name;
          2. Your date of birth;
          3. Your address;
          4. Your contact details (Telephone number and email); 
          5. The name of the Competition; and
          6. Your answer to the Competition question.
        3. Any incomplete or illegible entries will be disqualified.
        4. Bulk entries in one envelope will not be accepted as multiple entries and if a bulk entry is received, it will be counted as one single entry. Each Postal Entry must be submitted and posted separately.
    1. The Promoter will not accept:
      1. responsibility for Competition entries that are not successfully completed, are lost, mislaid, damaged or delayed regardless of cause, including, for example, as a result of any equipment or postal failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof of posting or transmission as proof of receipt of entry to the Competition.
    2. By submitting a Competition entry (whether purchased online or submitted as a free entry), you:
      1. confirm that you are eligible to enter the Competition;
      2. acknowledge that you are entering into a contract with the Promoter; and 
      3. agree to be bound by these Terms.
    3. You may make multiple entries for any Competition, subject to any entry limit as communicated by the Promoter, specific to any Competition.
    4. In the event that the Competition has reached maximum ticket entries prior to receiving the Postal Entry, it is at the Promoter’s discretion to enter that Postal Entry into another draw of similar value.
    5. Entrants must have an account created on the Website in order for the entry to be processed. The details must match the ones provided on the Postal Entry. Should the details not match, your entry will be disqualified.
  1. Choosing a winner
    1. All Entrants who correctly answer the Competition question will be placed into a prize draw and a single Entrant will be chosen at random as the winner. The Promoter will publish the correct answer to the Competition question on its Website. The random draw will take place on the same day as the Closing Date of the Competition, unless stated otherwise.
    2. In the instance that the name entered is flagged by our system as inappropriate we reserve the right to void the entry.
    3. In the event the draw is disrupted or we feel the outcome may have been manipulated, we can at our own discretion run the draw again, using the same or an alternative process.
  2. Eligibility
    1. The competition is open to all residents of United Kingdom aged 18 years or over, except for:
        1. employees of the Promoter (this includes Aposiopesis LTD and Rich Reels Media LTD);
        2. employees of agents and or suppliers of the Promoter who are connected with the Competition and its administration; or
        3. members of the immediate families or households of 5.1(a) and 5.1(b).
    2. The Promoter will not accept entries that are:
        1. automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
        2. completed by third parties or in bulk; or
        3. incomplete, illegible, have been altered, reconstructed, forged or tampered with.
    3. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Competition.
    4. By entering a Competition, you confirm that you are eligible to do so and are eligible to claim any prize that you may win. The Promoter may require you to provide proof that you are eligible to enter the Competition and claim the prize. If you fail to provide the Promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the Competition.
    5. Refunds may be given at the discretion of the Promoter. Failure to comply with the Terms does not mean you are eligible for a refund. You may also be prevented from entering further Competitions run by the Promoter.
  3. The prize
    1. The prize for a Competition will be described on the Website.
    2. Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value, including in cash. Should there be any changes to the prize, the Promoter will take reasonable steps to update the Website and notify any Entrants.
    3. The Promoter makes no other representations and gives no warranties about the prize, its value or condition or any of the information provided on the Website. The Promoter makes no representations and gives no warranties that the information provided on the Website is accurate, complete or up to date.
    4. The prize is non refundable, negotiable or transferable.
    5. If the prize is a vehicle;
      1. the Promoter will, unless otherwise stated, ensure it comes with a valid MOT (If required);
      2. no insurance is included with the prize and it is the winner’s responsibility to ensure the vehicle is adequately insured prior to taking it on the public roads (if it is legal to do so);
      3. the Promoter has no responsibility for the prize once it has been delivered/collected. The winner is solely responsible for complying with all relevant laws and regulations relating to the vehicle, its operation and ensuring they operate it in a safe and responsible manner;
      4. no vehicle/road tax is included; 
      5. the prize vehicle may not be the vehicle depicted in advertising or on the Website but shall be of similar specification.
      6. the winner may be required to show proof of valid insurance and driver’s licence prior to receipt of the vehicle;
      7. the winner shall be responsible for any additional accessories and/or equipment that is not included in the prize description; and
      8. the winner is solely responsible for ensuring they have all necessary safety equipment and clothing (for example, helmets, boots and gloves) and for wearing them whilst operating the vehicle.
    6. All prizes are subject to additional conditions, which will be set out on the Website page of the Competition itself.
  4. Winners
    1. The decision of the Promoter is final and no correspondence or discussion will be entered into.
    2. The Promoter will contact the winner of a Competition personally as soon as practicable after the draw date, using the telephone number or email address provided with the Competition entry.
    3. The Promoter will not amend any contact information once the Competition entry has been submitted.
    4. The Promoter will make all reasonable efforts to contact the winner by the email provided and/or phone number. If the winner cannot be reached or makes no contact within 14 days of the draw, the Promoter reserves the right to offer the prize to another eligible Entrant who will be selected using the same method. This process will continue until the prize is accepted.
    5. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners and, if applicable, their winning entries on its Website. 
  5. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at info@cotswoldcompetitions.co.uk prior to the Closing Date. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority upon request.
  6. Claiming the prize
    1. Winners must claim their prize personally. The prize may not be claimed by a third party on a winner’s behalf. 
    2. Details of how the prize will be delivered to the winner (or made available for collection) are published on the Website.
    3. Any cash prize will be transferred directly to the winner’s nominated bank account. The winner must provide evidence that it is the sole or joint beneficiary of the bank account. Failure to do so within 14 days of request by the Promoter will result in disqualification from the Competition and the winner forfeiting the prize. In such circumstances, the Promoter reserves the right to offer the prize to another eligible Entrant who will be selected using the same method.
    4. The Promoter does not accept any responsibility and is not liable to pay any compensation if a winner is unable to or does not take up the prize.
  7. Limitation of liability
    1. The Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
    2. The Promoter is not liable for any of the following;
        1. Any entires that are not received due to incorrect entry information, faulty or failed data transmissions or reasons of such.
        2. Unauthorised access to, theft, destruction or unauthorised modification to the entries at any point.
        3. Technical malfunctions, errors, failures, omissions, interruptions, delays or defects in regard ti any equipment and/or systems.
  8. Data protection AND PUBLICITY
    1. By entering the Competition, you agree that any personal information provided by you with the Competition entry may be held and used by the Promoter or its agents and suppliers for the purposes of administering and managing the Competition and prizes and of informing you of future competitions and our competition schedules or as otherwise set out in the Promoter’s Privacy Policy.
    2. If you submit content it may be used for reasonable publicity by the Promoter. If you do not wish to participate in any publicity, you must notify the Promoter. This will not affect your chances of winning the prize. If you do not agree to participate in any publicity about the Competition, we may still provide your details to the Advertising Standards Authority (ASA).
    3. In accordance with UK data protection legislation, you are entitled to request that the Promoter does not contact you and removes your details from its database.  If you make such a request you will be withdrawing from the Competition as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you withdraw from the Competition. If you do not wish any of your personal details to be used by the Promoter for promotional purposes, please email the Promoter at info@cotswoldcompetitions.co.uk
  9. General
    1. The Promoter reserves the right to amend these Terms from time to time. The latest version of these Terms will be available on the Website.
    2. If there is any reason to believe that there has been a breach of these Terms, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in a Competition and any future Competitions.
    3. The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so for circumstances out of its control. In such circumstances, the Promoter will refund any entry fees you have paid.
    4. The Competitions on the Website are in no way sponsored, endorsed, administered by or associated with Meta, Apple or Google. By entering the competitions, Entrants agree that neither Meta, Apple nor Google have any liability and are not responsible for the administration or promotion of the competitions.
    5. These Terms shall be governed by English law. Entrants submit to the exclusive jurisdiction of the courts of United kingdom.
    6. You are advised to print a copy of these Terms and keep them for your records.
  10. Promotional Codes and Discounts

Promotional codes, including signup discounts, are subject to change or cancellation at any time without prior notice. The availability, value, and duration of these codes may vary, and their use may be subject to specific conditions outlined during the promotion period. The Promoter reserves the right to amend, discontinue, or replace any promotional codes at its sole discretion.
